Response to State Auditor & Citizen Petition
The City of Guthrie received a request for documentation in late September of 2013 from the State Auditor's Office regarding inquiries and comments they had received from an individual in the Guthrie area. City staff compiled all requested information and provided documents, supplemental data, and comments to the State Auditor's Office in October of 2013. The State Auditor's Office has not found reason to audit the City of Guthrie further based upon their investigation.

Recently, individuals have circulated a Citizen Petition Request in an effort to require the State Auditor's Office to conduct a special audit at the cost of the City, regardless of the results of the previous inquiry. In this document, we do our best to answer concerns and questions from a few citizens. The City's intention is to always be forthcoming and transparent, and to provide equal access to information to all citizens.

All of the numbered items either came directly from the Citizen Petition Request in September of 2013 or from the State Auditor's Office. 1. "Possible irregularities in city purchasing policies and procedures in respect to its charter including but not limited to financing and construction of the city's water treatment plant, current indebtedness, and construction of water line to service Town of Coyle residents."

5. "Possible irregularities and improprieties by public officials in the approval and issuance of an unsecured loan to Excel Jet, Ltd."

6. City of Guthrie was awarded a $15,300,000 loan from the Oklahoma Water Resources Board to construct the Water Treatment Plant, work on the water intake structure, and replace the water main.
  • The loan was split into two (2) loans. The promissory notes were made on December 23, 2008, for $8,000,000 and on January 2, 2009, for $7,320,000.

7. Regarding the Initiative Petition filed Sept. 7, 2008, Karen Shandorf and Patty Hazelwood vs. Wanda Calvert, City Clerk/Treasurer, City of Guthrie, and Charles Burtcher, Mayor of the City of Guthrie, Oklahoma; the District Judge found that "the Plaintiff's initiative petition, if passed, would cause such undue hardship on the Authority and the City of Guthrie that it would destroy the city's ability to engage in the business of a utility."

8. Are the quarterly utility receivables reconciliation to the supporting detailed subsidiary ledger occurring?
  • Yes.

9. An adjusting audit entry totaling $105,000 was required to reconcile reported amounts to the subsidiary ledgers. What was this for?

  • Yes.

11. What is the current agreement between the City of Guthrie and the City of Edmond regarding the Guthrie Edmond Regional Airport? What is the membership of the Advisory Board?
  • The Advisory Board consists of seven (7) members; three (3) appointed by the City of Edmond, and four (4) appointed by the City of Guthrie.

15. How long did it take for the contractor to finish the Water Treatment Plant?
  • Work was completed approximately 150 days behind schedule and the contractor was charged $50,000 in fees.

16. What were the bids for constructing the Water Treatment Plant?

17. CMOM (Capacity, Management, Operations, and Maintenance) agreement and loan?
  • ODEQ (Oklahoma Department of Environmental Quality) mandate $1M-$1.5M of work.
